TERMS OF SERVICE

EQUALS GROWTH Ltd (trading as 10 startups. 1 year.) ('we', 'us', or 'our'), located at Unit 9a Highgrove Farm, Seaford, Pershore, WR10 2LF, provides various services including newsletters, websites, and social media content, collectively termed as 'Services'.

This document, along with our Privacy Policy, forms a binding agreement between you and EQUALS GROWTH Ltd. 

We reserve the right to update these terms, with changes becoming effective once posted on our Services. Continued use of the Services after changes implies acceptance. If not in agreement, please cease using the Services immediately.

1. CONTENT

Except for user-generated content, or as otherwise stated, all materials on our Services, such as audio, software, graphics, and text, including intellectual property, are owned by EQUALS GROWTH Ltd and/or our partners. You're granted a limited licence to access these materials for non-commercial, personal entertainment as long as you adhere to this Agreement. When you submit your own content, you grant us a broad licence to use and distribute it, and you affirm your rights to this content.

Content from third parties or users on our Services doesn't reflect EQUALS GROWTH Ltd’s views. Although we may moderate content, we're not obliged to check all user content for compliance. We're not liable for any third-party content. Other users maintain ownership of their content, which you cannot unlawfully use or modify.

2. CONDUCT

As a user, you must use the Services lawfully. Prohibited actions include, but are not limited to, engaging in illegal activities, posting harmful or infringing content, and attempting to breach the Services' security.

3. LINKS

Our Services may link to external sites, which are not under our control. We're not responsible for their content or reliability. Accessing these sites is entirely at your own risk. Links do not imply our endorsement. We may remove third-party links at our discretion. We may remove third-party links at our discretion.

4. SPECIAL PROMOTIONS AND REFERRALS

Participation in promotions, contests, or giveaways through our Services is governed by specific rules. By entering, you may be agreeing to the use of your information in accordance with these rules, including promotional use of your personal details, subject to legal restrictions.

Referrals are completed when a user signs up for our services using your unique referral link which can be seen in your account section. Once someone has clicked on that link and provided their email address, the referred user must verify their email address. If, after two weeks, a user has not verified their email address and subsequently signs up to the service, this sign-up will not be classified as a referral and will not be counted towards any promotions, contests or giveaways. 

5. THIRD-PARTY COMPANIES AND PROVIDERS

Our Services may lead to or enable interactions with third-party businesses. We're not responsible for these interactions. Any dealings, including purchases and services obtained through third parties, are solely between you and the respective business. Any disputes you may encounter with a third party service provider must be settled solely between you and that service provider.

6. DISCLAIMERS AND LIMITATION OF LIABILITY

The Services are provided 'as is' without warranties of any kind. We don't guarantee uninterrupted or error-free service. EQUALS GROWTH Ltd is not liable for indirect damages from using the Services.

Beyond the previously stated terms, EQUALS GROWTH Ltd, along with any associated third-party providers, does not make any explicit or implicit guarantees or representations concerning several aspects: (i) the functionality of the services, including all underlying information, content, materials, or products; (ii) the guarantee that the services will operate securely, continuously, or without errors; (iii) the accuracy, dependability, or timeliness of any information, content, or services provided; (iv) the assurance that servers or communications from us are free from viruses or other harmful elements.

EQUALS GROWTH Ltd explicitly denies responsibility for any actions taken by its users or for any content they contribute to the services. Additionally, we are not liable for any indirect, accidental, special, or consequential damages that may arise from using the services or from any products acquired through them. This applies even if we have been informed about the possibility of such damages. Our liability to you will not exceed the amount you have paid to us in the 180 days preceding the initiation of any claim. If you haven't made any payments during this period, your sole recourse is to stop using the services and cancel your account.

It is important to note that certain jurisdictions do not permit the limitation on implied warranties or the exclusion of certain types of damages. If these legal provisions apply to you, then some or all of the aforementioned disclaimers, exclusions, or limitations may not be applicable, and you might have additional rights.

7. LEGALITY

You're responsible for complying with laws applicable to your use of the Services. We make no representation regarding the legality of the Services in your jurisdiction

8. APPLICABLE LAW; JURISDICTION

The Services are created and controlled by us in the United Kingdom. Therefore this Agreement is governed by the laws of the United Kingdom

9. INDEMNITY

You agree to indemnify, and hold harmless EQUALS GROWTH LTD, along with our officers, agents, partners, and employees, from any losses, liabilities, claims, or demands, including reasonable legal fees, that may arise due to your violation of this Agreement or your representations and warranties. This indemnification covers claims made by any third party due to your actions or content you provide.

10. SEVERABILITY

This Agreement comprises multiple individual provisions. If any provision is found to be invalid or unenforceable in any jurisdiction, such a finding will not affect the validity or enforceability of the other provisions of this Agreement or the effectiveness of the entire Agreement in other jurisdictions.

11. ELECTRONIC COMMUNICATIONS

By engaging with our Services or sending us emails, you are participating in electronic communications. You hereby consent to receive communications from us in an electronic form, whether via emails or notices on our Services. You acknowledge and agree that all agreements, notices, disclosures, and other communications provided electronically satisfy any legal requirements for written communication.

12. OTHER

This Agreement is automatically accepted when you use any of our Services. Our failure to enforce any right or provision of this Agreement should not be seen as a waiver of such rights or provisions. The section headings in this Agreement are used merely for convenience and have no legal or contractual significance.
